Summary Comparison of CSU Agreement Types

Agreement Type Use for: Limitations on Use
CSU Architect/Engineer Agreement for use on Design-Bid-Awards Projects A/E design services for Design-Bid-Awards major capital projects. Intended as the ‘owner/architect agreement’ for Design-Bid-Awards major capital building projects.
Typically not appropriate for use on minor capital projects or supporting design services due to extensive deliverables defined in agreement.
 
CSU Architect/Engineer Agreement for use on CM@Risk Projects A/E design services for CM@Risk major capital projects. Intended as the ‘owner/architect agreement’ for CM@Risk major capital building projects.
Typically not appropriate for use on minor capital projects or supporting design services due to extensive deliverables defined in agreement.
Service Agreements Design services for Minor Capital or JOC projects Supporting design services for any project CEQA, feasibility, master plan studies Miscellaneous professional services and specialty design services such as: geotechnical, hazardous material reviews, acoustical, laboratory or other design studies, testing or inspection, services. Service Agreements do not contain the comprehensive framework of deliverables identified in the CSU A/E Agreement thus campuses must use care to develop Service Agreement Scopes of Service to sufficiently describe the work including as needed: project description, schedule, deliverables, fee, payment times, cost estimates and detail level of to be provided, listing of consulting engineer disciplines to be provided, listing of plan reviews required and coordination expected, extent of bidding support, extent and frequency of construction administration support, extent of record documents required, etc.
Task Order Service Agreements for Professional Services Supporting design services for any project. Ideal for design services on Minor Capital and JOC projects. Same as Service Agreements plus the following: Total Amount of Agreement Services limited to $400,000. This amount has no relationship to the minor cap limit. Services may be provided on a Major Capital or Minor Capital project. Agreement term limited to one year. May not issue multiple concurrent agreements to a single service provider.
Systemwide Master Enabling Service Agreements Plan check reviews, Seismic Peer Reviews, Mechanical Systems reviews, Commissioning. Must use Service Order Authorizations to initiate services. The base enabling agreements may only be implemented by CPDC CO. Extra Services directly related, but outside of the MEA scope may be authorized by the campus.
Energy Service Agreements Use within ESA program. This program has expired. Contact CPDC Plant Energy & Utilities Group for further information on this expired program.
(New) Task Order Construction Agreements
(TOCA)

All minor capital projects. Major capital projects up to $2.5MM

Designed to facilitate multiple small repair, retrofit and energy improvement projects
Agreement currently under development. Will follow a modified CM at Risk model utilizing a task order service model with contractor to retain design services.

1-year term, with subsequent 1 year option to renew. Task Order work authorizations. Part A design services, Part B construction services anticipated.

Anticipate trial availability beginning mid-2014.

All minor capital projects. Major capital projects up to $2.5MM

Feasibly and non-construction specific studies should use a Service Agreement.
Streamlined requirements Agreement for ‘owner’ retained design services for small projects intended for construction.

Not appropriate for non-construction projects or projects exceeding 2.5MM
